class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Un contrato de arrendamiento comercial es un contrato de alquiler a largo plazo (normalmente 9 a\u00f1os) entre el propietario del local (el arrendador) y un comerciante, industrial o artesano (el arrendatario). Este contrato establece los derechos y obligaciones de ambas partes y, en particular, protege al arrendatario que ejerce una actividad comercial, industrial o artesanal en el local. <\/p>\n<h2><span class=\"ez-toc-section\" id=\"%C2%BFQuien_puede_optar_a_un_arrendamiento_comercial\"><\/span>\u00bfQui\u00e9n puede optar a un arrendamiento comercial?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>El arrendamiento comercial cubre :<\/p>\n<ul>\n<li>Comerciantes inscritos en el Registro Mercantil y de Empresas (RCS)<\/li>\n<li>Artesanos inscritos en el registro de oficios<\/li>\n<\/ul>\n<p>Para ello, el local debe destinarse a una actividad comercial, industrial o artesanal. En algunos casos, determinadas profesiones liberales tambi\u00e9n pueden optar a un arrendamiento comercial. <\/p>\n<h2><span class=\"ez-toc-section\" id=\"%C2%BFPor_que_elegir_un_arrendamiento_comercial\"><\/span>\u00bfPor qu\u00e9 elegir un arrendamiento comercial?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Un contrato de arrendamiento comercial ofrece una estabilidad inestimable para el negocio de un minorista: protege contra la rescisi\u00f3n injusta del contrato y da derecho a renovarlo. Esto permite al operador invertir en el acondicionamiento de su local o crear una clientela fiel sin temor a un desalojo repentino. <\/p>\n<h2><span class=\"ez-toc-section\" id=\"Principales_caracteristicas_de_un_arrendamiento_comercial\"><\/span>Principales caracter\u00edsticas de un arrendamiento comercial<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<h3><span class=\"ez-toc-section\" id=\"Plazo_el_famoso_arrendamiento_%C2%AB3-6-9\"><\/span>Plazo: el famoso arrendamiento \u00ab3-6-9<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>El contrato de arrendamiento comercial est\u00e1ndar tiene una duraci\u00f3n de <strong>9 a\u00f1os<\/strong>, pero el arrendatario puede rescindirlo cada 3 a\u00f1os (de ah\u00ed el nombre de \u00abcontrato 3-6-9\u00bb). El arrendatario puede notificarlo al final de cada periodo de tres a\u00f1os, con un preaviso de 6 meses, generalmente mediante acta de alguacil o carta certificada con acuse de recibo. <\/p>\n<p>El propietario s\u00f3lo puede rescindir el contrato de alquiler antes de 9 a\u00f1os en circunstancias muy limitadas (impagos, delitos graves, etc.), a menos que se haya llegado a un acuerdo amistoso.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Alquiler_fijacion_y_revision\"><\/span>Alquiler: fijaci\u00f3n y revisi\u00f3n<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>El alquiler se fija libremente en el momento de la firma. Sin embargo, puede revisarse cada 3 a\u00f1os (revisi\u00f3n trienal), de acuerdo con el \u00edndice de alquiler comercial (ILC). Esta revisi\u00f3n debe cumplir ciertas normas para evitar aumentos excesivos.  <\/p>\n<p>En el momento de la firma, el propietario tambi\u00e9n puede pedir una <strong>fianza<\/strong>, a menudo equivalente a entre 1 y 3 meses de alquiler.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Tasas_obras_y_reparaciones\"><\/span>Tasas, obras y reparaciones<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>El contrato de alquiler comercial debe especificar qu\u00e9 gastos debe pagar el inquilino y cu\u00e1les el propietario (impuestos, mantenimiento, reparaciones importantes, etc.). El desglose debe establecerse claramente por escrito; de lo contrario, la ley establece unas normas m\u00ednimas para proteger al inquilino. <\/p>\n<p>Desde 2014 (ley Pinel), ya no se pueden imponer al inquilino determinadas cargas elevadas (por ejemplo, obras estructurales importantes).<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Cesion_y_subarriendo\"><\/span>Cesi\u00f3n y subarriendo<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Un comerciante puede ceder su contrato de arrendamiento (transferir el contrato a un cesionario, a menudo en el momento de la venta del negocio), siempre que se cumplan determinadas condiciones. En general, el arrendador debe dar su consentimiento o ser informado, y el contrato no puede prohibir totalmente la cesi\u00f3n del arrendamiento con el negocio. <\/p>\n<p>Est\u00e1 prohibido <strong>subarrendar<\/strong> (prestar o alquilar el local a un tercero), salvo consentimiento expreso del arrendador.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Derecho_a_la_renovacion\"><\/span>Derecho a la renovaci\u00f3n<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>\u00c9ste es uno de los pilares del contrato de arrendamiento comercial: al final del plazo de 9 a\u00f1os, el arrendatario tiene derecho a renovar el contrato. El arrendador s\u00f3lo puede negarse a renovar el contrato por motivos muy concretos (por ejemplo, si se hace cargo del local para vivir en \u00e9l o montar su propio negocio) y, salvo excepciones, tendr\u00e1 que pagar al arrendatario una indemnizaci\u00f3n por desahucio. <\/p>\n<h2><span class=\"ez-toc-section\" id=\"Pasos_para_firmar_un_contrato_de_arrendamiento_comercial\"><\/span>Pasos para firmar un contrato de arrendamiento comercial<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<ol>\n<li><strong>Negociaci\u00f3n<\/strong>: Acuerdo sobre alquiler, distribuci\u00f3n de cargas, duraci\u00f3n, cl\u00e1usulas especiales (actividad autorizada, obras, etc.).<\/li>\n<li><strong>Firma del contrato<\/strong>: Redacta un contrato de alquiler detallado y por escrito que cumpla la ley.
